Terms of Use

These Terms of Use (“Terms”) apply to Tuna (the macOS app), the Tuna website, and related services provided by Brainbow v/ Mikkel Malmberg (“Brainbow”, “we”, “us”).

By using Tuna, you agree to these Terms.

1. Using Tuna

You may use Tuna for lawful purposes. You are responsible for how you use Tuna, including actions triggered through Tuna (for example scripts, automations, shell commands, integrations, and file operations).

You must not use Tuna to violate laws, infringe rights, or harm systems, data, or other users.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Tuna in accordance with these Terms.

3. Pro purchases and licensing

If you buy Tuna Pro, payments are processed by Stripe. Purchase, billing, and payment data are handled under Stripe’s terms and privacy practices.

License keys and activation are provided to enable Pro features and enforce device limits.

4. Privacy

Your use of Tuna is also governed by our Privacy Policy.

5. Disclaimer of warranties

Tuna is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

6. Limitation of liability

To the fullest extent permitted by law, Brainbow v/ Mikkel Malmberg is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of business, or system damage arising from or related to Tuna.

You are solely responsible for backups and for verifying actions before running them.

Nothing in these Terms excludes or limits liability where such exclusion is not permitted by applicable law.

7. Indemnity

You agree to indemnify and hold harmless Brainbow v/ Mikkel Malmberg from claims, liabilities, damages, and expenses arising from your misuse of Tuna or violation of these Terms.

8. Changes and termination

We may update Tuna or these Terms from time to time. We may suspend or terminate access if these Terms are violated.
